1. GENERAL INFORMATION

This Legal Notice governs access to and use of the web platform (hereinafter, the "Platform"), so we recommend taking a few minutes to read it.

 The Platform is owned by Intellego Education Services Limited (hereinafter, "INTELLEGO" or "we"), an entity with its registered address at 29 Farm Street, London W1J 5RL, United Kingdom and Company Number 16010464.

2. TERMS OF USE
Browsing and using the Platform grants you the status of a user and implies your acceptance of each and every provision included in this Legal Notice, as in force at the time of your access. If you do not agree with these terms, we kindly ask you to stop using the Platform.

This Legal Notice applies independently of any specific conditions that INTELLEGO may establish for the regulation of certain services and/or content, which, where applicable, must be accepted by the user prior to the provision of the corresponding service, or the applicable General Terms and Conditions of Contract.

Accessing and/or browsing the Platform is free of charge.

If you are required to enter personal data into any forms available on the website, the information provided must be truthful, accurate, and up to date. INTELLEGO will process your data in accordance with the provisions of its Privacy Policy.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY

As a user, you agree to use the content and services made available on the Platform, which include, but are not limited to, texts, graphics, images, icons, technology, software, links, and other digital, audiovisual, or sound content, as well as the graphic design and source codes (hereinafter, the "Content"), in accordance with the law, this Legal Notice, and the applicable usage regulations and instructions provided to you. In particular, you agree to refrain from:

  •  Reproducing, copying, distributing, making available, or otherwise publicly communicating, transforming, or modifying, in whole or in part, the services and Content unless authorized by the rightful owner of the corresponding rights or when legally permitted;
  • Removing, manipulating, or otherwise altering the copyright notice and other identifiers of INTELLEGO ‘s or third parties' reserved rights;
  • Exercising or misusing the rights of exploitation associated with such Content unless expressly authorized by its legitimate owner and, where applicable, in the conditions expressly agreed upon.

All trademarks, names, distinctive signs, content architecture (design, navigation, structure, and taxonomy of the Platform and its Content, etc.), and any software or content incorporated into the Platform are the property of INTELLEGO or third parties. The use or access to the Platform and/or its Content or services does not grant you, as a user, any rights over such trademarks, trade names, or distinctive signs, nor over any other elements provided through the Platform.

 In short, the Content and other services are subject to the intellectual or industrial property rights of INTELLEGO or third parties. No rights over them are transferred to the user under this Legal Notice beyond what is strictly necessary for the correct use or access to the Platform and its services and Content (for personal use only, non-sublicensable to third parties due to the nature of the service and associated legal requirements).

 If, as a user, you incorporate or export any content protected by intellectual or industrial property rights when accessing or using the Website, you acknowledge and, where necessary, undertake to obtain in advance all necessary authorizations to ensure INTELLEGO’s peaceful use of such content.

4. PROHIBITED USES
As a user of the Platform, it is PROHIBITED to:

  1.  Use any of the services or content provided through the Platform for illegal purposes or in a manner that harms the rights and interests of INTELLEGO or third parties.
  2. Damage, disable, overload, deteriorate, or prevent the normal use of the Platform, as well as engage in any form of cyberattack on the Platform, its systems, or associated processes.
  3. Transmit, communicate, or make available to third parties any information or data, or any type of content that violates fundamental human rights.
  4. Use bot techniques, screen scraping, web scraping, or any other programming or technological tools to extract and, if applicable, reuse the information or data hosted, stored, or accessible on the Platform without the express and written authorization of INTELLEGO
  5. Establish a hyperlink to the Platform that reproduces or links to specific content without written authorization from INTELLEGO. The hyperlink may only direct to the homepage.

If these prohibitions are violated and INTELLEGO becomes aware of such violations, we may warn you to cease these activities, request their immediate removal or correction, or directly delete or block the offending content. Additionally, we may suspend, deactivate, or delete your user account, if applicable, without entitling you to any compensation.

  • 5. DISCLAIMER OF WARRANTIES AND LIABILITY
    INTELLEGO does not guarantee the availability or continuous operation of the Platform and its services, whether proprietary or third-party. Whenever reasonably possible, prior notice will be given regarding interruptions in the Platform’s operation.
  • INTELLEGO does not guarantee that the content is free from viruses or other elements that may affect your system, although it will take necessary measures to prevent and correct such issues.
  • INTELLEGO cannot fully guarantee the truthfulness, accuracy, completeness, timeliness, legality, reliability, or usefulness of the content and services on the Platform, especially those provided by third parties.
  • INTELLEGO may offer links, directories, and search tools (such as links, banners, and buttons) to facilitate user access to websites managed by third parties. These links are solely intended to help users find information on the Internet.
  • INTELLEGO neither sells nor endorses the information, content, or services of the linked sites and does not monitor or control their content. Users are solely responsible for accessing such sites.
  • INTELLEGO does not control or identify with the opinions, comments, or actions of users on the Platform.
  • Users of the Platform are solely responsible for the actions, evaluations, content, and information they publish, transmit, communicate, or contribute through the Platform.

Despite the prohibitions and established rules, INTELLEGO does not guarantee nor takes responsibility for how users utilize the Platform and its content. However, it may implement security systems and take corrective measures when it becomes aware of violations, ensuring the legitimacy of services, content, and comments, without assuming an obligation of oversight.

In all the aforementioned cases, INTELLEGO is exempt from any liability for damages or harm that may arise, to the fullest extent permitted by applicable law, whether towards users or third parties.

 6. VALIDITY

If any provision of this Legal Notice is declared null or invalid, the remaining provisions will remain valid and enforceable. Waiving the enforcement of a provision at any given time does not imply waiving the rest of the provisions nor does it grant additional rights.

 7. MODIFICATION OF THE LEGAL NOTICE

INTELLEGO reserves the right to modify the presentation and configuration of the Platform, as well as this Legal Notice, at any time. We recommend that you carefully read this Legal Notice each time you access the Platform, as it may be updated for legal, technical, or corporate reasons.

1. INFORMACIÓN GENERAL

El presente Aviso Legal regula el acceso y uso a la plataforma web (en adelante, la “Plataforma”) por lo que te recomendamos dedicar unos minutos para leerlo. 

La Plataforma se encuentra bajo la titularidad del Intellego Education Services Limited (en lo que sigue, “INTELLEGO”), con CIF 16010464 domicilio social en 29 Farm Street, London W1J 5RL, Reino Unido.

2. CONDICIONES DE USO

La navegación y la utilización de la Plataforma te atribuye la condición de usuario de la misma e implica tu aceptación de todas y cada una de las disposiciones incluidas en este Aviso Legal, vigente en cada momento en que accedas a la Plataforma.  Si no estás de acuerdo con estas condiciones, te rogamos que dejes de utilizar la Plataforma.

 Este Aviso Legal será de aplicación independientemente de las condiciones particulares que pudiera establecer INTELLEGO para la regulación de determinados servicios y/o contenidos, y que, en su caso, deberán ser aceptadas por el usuario antes de realizarse la prestación del servicio correspondiente, o de las Condiciones Generales de Contratación que resulten de aplicación. 

 El acceso y/o navegación a través la Plataforma tiene carácter gratuito.  

En caso de que debas introducir datos personales en los formularios disponibles en la web, estos deberán ser veraces, exactos y actualizados. INTELLEGO tratará tus datos conforme a lo dispuesto en la Política de Privacidad. 

3. PROPIEDAD INTELECTUAL E INDUSTRIAL.

Como usuario, te comprometes a utilizar los contenidos y servicios puestos a disposición de los mismos en la Plataforma, entendiendo por éstos, sin que esta enumeración tenga carácter limitativo, los textos, gráficos, imágenes, iconos, tecnología, software, links y demás contenidos digitales, audiovisuales o sonoros, así como su diseño gráfico y códigos fuente (en adelante, los «Contenidos»), de conformidad con la ley, este Aviso Legal, reglamentos de uso e instrucciones puestos en su conocimiento. En particular, te comprometes a abstenerte de:

  • Reproducir, copiar, distribuir, poner a disposición o de cualquier otra forma comunicar públicamente, transformar o modificar total o parcialmente los servicios y contenidos, a menos que se cuente con la autorización del titular de los correspondientes derechos o ello resulte legalmente permitido;
  • Suprimir, manipular o de cualquier forma alterar el «copyright» y demás datos identificativos de la reserva de derechos de INTELLEGO o de terceros.
  •  Ejercitar u abusar del ejercicio de los derechos de explotación asociados a tales contenidos, salvo que haya sido expresamente autorizado a tal fin por su legítimo titular y, en su caso, a hacerlo en las condiciones expresamente pactadas al respecto.

Todas las marcas, nombres, signos distintivos, arquitectura de contenidos (diseño, la navegación, la ordenación y la taxonomía de la Plataforma y sus contenidos, etc.) y los contenidos o software de cualquier clase que se incorporan en la Plataforma son propiedad del  INTELLEGO, o de terceros, sin que pueda entenderse que el uso o acceso a la Plataforma y/o a los contenidos o servicios, te atribuya como usuario derecho alguno sobre las citadas marcas, nombres comerciales y/o signos distintivos, así como sobre cualquiera de otros elementos dispuestos a través de ésta.

En definitiva, los contenidos y demás servicios se encuentran bajo la propiedad intelectual o industrial de INTELLEGO, o de terceros, sin que puedan entenderse cedidos al usuario, en virtud de lo establecido en este Aviso legal, ninguno de los derechos que recaigan o puedan recaer sobre los mismos, más allá de lo estrictamente necesario para el correcto uso o acceso a la Plataforma y a los servicios y contenidos (uso personal no sub-licenciable a terceros por las propias características del servicio y demás requerimientos legales asociados) que, a través del mismo, se presten o pudieran prestar al usuario. 

En el caso en el que, como usuario, con ocasión del acceso o uso del Sitio Web, incorpores o exportes algún contenido protegido por un derecho de propiedad intelectual e industrial, reconoces o, en su defecto, te comprometes a adquirir con anterioridad, todas las autorizaciones que resulten necesarias para garantizar a INTELLEGO el uso pacífico de dichos contenidos.

4. USOS NO PERMITIDOS.

Queda PROHIBIDO, como usuario de la Plataforma:

  1.  Utilizar cualquiera de los servicios o contenidos dispuestos a través de la Plataforma con fines o efectos ilícitos o lesivos para los derechos e intereses de INTELLEGO, o de terceros. 
  2. Dañar, inutilizar, sobrecargar, deteriorar o impedir la normal utilización de la Plataforma, así como ciberatacar en modo alguno la Plataforma, sistemas o procesos asociados.
  3. Transmitir, comunicar o poner a disposición de terceros información o datos y, en general, cualquier clase de contenidos que sea contraria a los derechos fundamentales de las personas. 
  4. Utilizar técnicas de bots, screen scraping, web scraping o cualquier otra herramienta de programación o de cualquier otra índole que permita extraer y, en su caso, reutilizar, la información o datos alojados, almacenados o accesibles en la Plataforma sin autorización expresa y por escrito del INTELLEGO.
  5. En caso de establecer un hiperenlace a la Plataforma, reproducir o enlazar a contenidos específicos sin la autorización escrita de INTELLEGO; el hiperenlace solo puede dirigir a la página de inicio.

En caso de vulnerar estas prohibiciones, y desde el momento en que INTELLEGO tenga conocimiento de estos hechos, podremos advertirte sobre la necesidad de detener dichas actividades, solicitar su eliminación o corrección inmediata o directamente suprimir o bloquear dicho contenido. También podremos suspender, desactivar o suprimir tu cuenta de usuario, en caso de existir, sin que ello genere derecho o indemnización dineraria alguna.

5. EXCLUSIÓN DE GARANTÍAS Y DE RESPONSABILIDAD

  • INTELLEGO no garantiza la disponibilidad y continuidad del funcionamiento de la Plataforma y de los servicios dispuestos a través de la misma, ya sean propios o de terceros. Cuando ello sea razonablemente posible, advertirá previamente de las interrupciones en el funcionamiento de la Plataforma. 
  • INTELLEGO no garantiza que los contenidos estén libres de virus u otros elementos que puedan afectar tu sistema, aunque tomará las medidas necesarias para prevenir y corregir estos problemas.
  • INTELLEGO no puede garantizar completamente la veracidad, exactitud, integridad, actualidad, legalidad, fiabilidad y utilidad de los contenidos y servicios de la Plataforma, especialmente los proporcionados por terceros.
  • INTELLEGO puede ofrecer en la Plataforma enlaces, directorios y herramientas de búsqueda (como links, banners y botones) para facilitar a los usuarios el acceso a sitios web gestionados por terceros. Estos enlaces solo tienen el propósito de ayudar a los usuarios a encontrar información en Internet.
  • INTELLEGO no comercializa ni respalda la información, contenidos o servicios de los sitios enlazados, ni supervisa o controla su contenido, siendo el usuario el único responsable de navegar en ellos. 
  • INTELLEGO no controla ni se identifica con las opiniones, comentarios o acciones de los usuarios en la Plataforma. 
  • Los usuarios de la Plataforma son, con carácter general, los únicos responsables por las actuaciones, valoraciones, contenidos e información que publiquen, transmitan, comuniquen o aporten a través de la Plataforma.

A pesar de las prohibiciones y reglas establecidas, INTELLEGO no garantiza ni se responsabiliza del uso que los usuarios hagan de la Plataforma y sus contenidos. No obstante, podrá implementar sistemas de seguridad y tomar medidas correctivas cuando tenga conocimiento de incumplimientos, velando por la legitimidad de los servicios, contenidos y comentarios, sin asumir una obligación de control.

En todos los anteriores supuestos, INTELLEGO se exime de cualquier responsabilidad, daños o perjuicios que se produzcan o pudieran producir, con toda la amplitud permitida por el ordenamiento jurídico aplicable, ya se sea frente al usuario o terceros.

6. VALIDEZ 

Si alguna de las estipulaciones del presente Aviso Legal es declarada nula o inválida, las demás seguirán siendo válidas y vinculantes. Renunciar al cumplimiento de una estipulación en un momento dado no implica la renuncia al resto de estipulaciones ni otorga derechos adicionales.

7. MODIFICACIÓN DEL AVISO LEGAL 

INTELLEGO se reserva el derecho de modificar, en cualquier momento, la presentación y configuración de la Plataforma, así como el presente Aviso Legal. Te recomendamos que, cada vez que accedas a la Plataforma, leas atentamente este Aviso Legal, ya que este puede experimentar modificaciones por motivos legales, técnicos, corporativos.
